Terms of Service

These Terms govern your use of the Zups mobile app and the zupstravel.com website. By using Zups, you agree to them.

Zups is operated by James Zupa. Where these Terms say "Zups", "we", or "us", they refer to the operator. Reach us at jameszupa@zupstravel.com.

1. What Zups is

Zups is a travel planning and decision-support tool. You use Zups to browse trip ideas, plan a trip across multiple cities, save trip inspirations, craft postcards from trips you take, keep a small travel journal, and — when you're ready — hand off to a third-party booking partner to actually book flights, accommodations, ground transport, or experiences.

Zups is a planning layer, not a travel provider. Zups is not an airline, hotel, hostel, accommodation host, ferry operator, train operator, bus operator, tour operator, guide, insurance broker, or booking company. When you book, you're booking with a third party through their website — see Affiliate Disclosure.

2. Third-party bookings — important

Zups helps you find and compare travel options, but the actual booking happens on a partner's website. The partner — not Zups — is responsible for:

If something goes wrong with a booking, please contact the partner you booked with — they hold the reservation. Zups can't refund, rebook, or intervene in a partner's transaction.

3. Travel information — verify important things yourself

Travel information changes. Prices, schedules, routes, availability, transportation options, entry requirements, visa rules, passport rules, health requirements, currency rules, and safety conditions can all change without notice, and information shown in Zups may not reflect the situation on the day you travel.

For anything that would materially affect your trip if it were wrong — visas, passport rules, vaccination or health requirements, border rules, driving requirements, currency restrictions, safety advisories, and specific transportation schedules or availability — you must verify the current requirement with an authoritative source before you rely on it. That usually means the destination's official government website, your own country's foreign-office travel advisories, the transportation or accommodation provider directly, and the booking partner's own policies.

Zups does not guarantee that any specific fact shown in the app is complete, accurate, or up-to-date. Consequential travel decisions should be based on the underlying authoritative source, not on Zups.

5. Content you create

You own the content you create in Zups — postcards, captions, journal entries, trips you plan. By using Zups, you give us the licence we need to display that content back to you inside the app, store it on our servers, and — if you deliberately share a postcard to a Community — display it to other members of that Community.

We don't claim ownership of your content. We don't publish it outside the app. We don't sell it, and we don't use it to train third-party models.

Community rules

Communities are the one shared space inside Zups today. When you post there, other members can see what you posted. Basic rules:

We may hide, remove, or restrict content that violates these rules, and we may suspend or terminate accounts that repeatedly violate them or that abuse the service.

Reports and takedowns

Any user can report a postcard shared to a Community. If three or more distinct users report the same postcard, it is automatically hidden from public view pending review. We also apply a server-side filter that rejects obviously abusive text before it ever becomes visible. If you see something serious, email jameszupa@zupstravel.com.

If you're a rights-holder and believe content on Zups infringes your copyright, email jameszupa@zupstravel.com with the specifics (what content, where it appears, your rights basis, and how to contact you) and we'll take a look.

Zups is an evolving product. Features may change or move. Some parts of the app may occasionally break. We work to fix issues quickly, but we do not guarantee uninterrupted service.

8. Disclaimers

Zups is provided "as is" and "as available", without warranties of any kind, whether express or implied — including implied warranties of merchantability, fitness for a particular purpose, non-infringement, or that the app will be error-free or uninterrupted. We do not warrant the accuracy, timeliness, or completeness of any travel information shown in the app. Nothing in these Terms limits any warranty that can't legally be excluded where you live.

9. Limitation of liability

To the maximum extent permitted by applicable law:

Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law, including for fraud, gross negligence, or death or personal injury caused by our negligence. Some jurisdictions do not allow certain limitations of liability, so parts of this section may not apply to you.

10. Indemnity

If your use of Zups violates these Terms or applicable law, and that violation causes us to face a third-party claim or loss, you agree to reasonably indemnify us for it. In plain English: if you break the rules and it costs us, that's on you.

11. Governing law and disputes

These Terms are governed by the laws of the State of New Jersey, United States, without regard to its conflict-of-law rules. Any dispute you cannot resolve informally with us will be brought in a court of competent jurisdiction located in New Jersey, unless a mandatory consumer-protection law where you live requires otherwise.

12. Changes to these Terms

If we change these Terms materially, we'll update the "Last updated" date and, for meaningful changes, notify active users inside the app or by email. Continuing to use Zups after a change means you accept the new Terms.
